I had a similar reaction. This episode is exceptionally poorly timed given the Court's ruling in Callais. Not the time to be promoting their book on why the court isn't actually all that bad, and how it's really Congress's fault when it makes an unpopular decision; meanwhile, it just usurped the power of that very body (and thereby the people) to nullify critical Civil Rights legislation – only the latest, but a glaring example, of the majority's tendency to bend legal reasoning to fit its ideology. This is a grave institutional problem in the Court, and we can't afford to whitewash it.
While not suggesting it was never discussed by the Founders while writing the Constitution, I am surprised they did not see the Achilles Heel of their adoption of the separation of powers doctrine - checks and balances - as the primary nonviolent method of preventing the tyranny America rebelled against. Perhaps they did/could not imagine the power of one political party to control all three branches of the federal government as is true today. And, if so, this also confirms the necessity of correcting flaws and injustices of the original document and not espousing so-called "originalism" trying to preserve never ending speculation about what the Founders meant in 1787.
Your view is growing, that the Constitution, as hallowed as it may be, is outdated. It was written by and for white, landed gentry and doesn't always hold up well for the diverse and highly complex country that has developed over 250 years. It would be a yeoman's work to do, but as everything, the institutions of government, media, medicine, education and law fall away under pressure from this deeply disruptive and dangerous regime, it may yet yield the opportunities for real, moral, structural and political change.
